We set out below our terms and conditions which shall apply to all transactions on CLARA curtains website.
‘Website means the website located at www.claracurtains.com
‘Conditions’ means these terms and conditions.
‘Product’ means a product displayed for sale on the Website.

You should read through these carefully before you place your order. We recommend you print out a copy of these terms and conditions for your future reference. Please also read our Data Protection Policy regarding personal information you provide to us.

We may amend these terms and conditions from time to time without notice to you. All changes will apply to any subsequent orders you place with and received by us.

 

The Contract between you and us

 

Contract Creation

  • The technical steps required to create the contract between you ad us are as follows:
  • You place the order for your products on the Website by completing the checkout process.
  • We will send you an order acknowledgement email detailing the products you have ordered. This is not an order confirmation or order acceptance from Imakdynamic UK Limited
  • As your order is despatched we will send you a despatch confirmation email.
  • Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the Products
  1. We must receive payment of the whole of the price for the goods that you order before your order can be accepted.
  2. Goods are subject to availability. If the goods at the time of your order are not in stock we will not process your payment until we confirm to you that the goods are in stock or in our warehouse.
  3. If the goods at the time of your order are no longer available, we will not process your payment and will advise you accordingly. A full refund will be given where you have already paid for the goods.
  4. In all cases, our acceptance of your order brings into existence a legally binding contract between us.
  5. We file details of your order. Please read our Privacy Policy for details of how these can be obtained.
  6. You warrant that the personal information which you are required to provide when you register as a customer is true, accurate and complete and that you will notify us of any changes.

 

Indemnity

You agree fully to indemnify, defend and hold us, our officers, directors, employees, agents and suppliers, harmless from and against all claims, liability, damages, losses, costs and expenses, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this website, or the use by any other person accessing the Website using your account or personal information.

 


Payment terms

Unless agreed otherwise, all payments must be made in Euro and can be made using any of the following methods: Visa, Mastercard, Discover and American Express via Paypal. We also accept SEPA wire transfer. SEPA (Single Euro Payments Area) payment is an electronic bank transfer (wire transfer), in Euro Bank Transfers.

 

Our rights

We reserve the right to:

  • modify or withdraw this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for modification to or withdrawal of the Website: and/or
  • change the conditions from time to time, and your continued use of the Website or any part of it following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any of change to the Conditions then you must immediately stop using the Website.

     

Price

  1. The price you pay is the price displayed on this website at the time we receive the order.
  2. While we try to ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods we will notify you as soon as possible and give you the option of reconfirming your order at the correct price at or cancelling it. If we are unable to contact you, we will treat your order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
  3. You can make payment in any method specified in the Ordering and Delivery section. We will take all reasonable precautions to keep the details of your order and payment secure. However, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.

 

Returns, refunds and cancellations

The following products are made to order; therefore they are non-refundable/non-returnable:

•  Made to measure curtains
•  Made to measure voile curtains
•  Cushions
•  Bedspreads
•  Fabric orders

All customers will receive an order confirmation email, this outlines your order in full including the exact measurements (in centimetres) of your order - please always check this and if there are any amendments to be made to the order, please ensure these are made to us by email within 24 hours of placing the order. If we have not been contacted within the 24 hour period, we shall assume that all the details are correct. 

Because of the bespoke nature of our products, there are some issues that we can't accept returns or issue full refunds for. Please note our cancellations/returns and refunds policy below:

 

Bespoke product returns/refunds

We will accept returns and consider replacements or full or partial refunds if there is a significant problem with the quality of manufacture or faults with the fabric. In most cases we will try to fix any issues in our workshop. We cannot accept returns in situations where we have been given incorrect measurements.

 

Bespoke product cancellations

If you wish to cancel a bespoke order, a full refund will be given if you cancel within 24 hours of placing the order, providing you notify us in writing (email).  After this 24 hour period has passed, any cancellations will incur manufacturing, material and cutting costs therefore we will retain 50% of the order and we will refund you the balance of your order back to you.

 

Fabric orders

We advise customers ordering fabric from us, to always check the fabric, prior to cutting, as once the fabric is cut; it is deemed non-refundable/non-returnable.

 

Ready-Made Curtain Order Cancellations

Our aim is to ensure that you're entirely happy with your purchase. If you're not completely satisfied with your curtains, please get in touch and we'll be happy to help.

If you'd like to cancel your ready made curtain order, please email us within 7 working days of receiving the goods. If you receive the goods before you've cancelled, please contact us for guidance on re-packaging before sending them back to us. The goods being returned should be unused (heading tapes must not be pulled etc.), together with the packaging.  If you cancel your order while it's on its way to you, simply keep the curtains in their original packaging and return them to us in their same condition they arrived in. Contact us as soon as you can upon receiving the package.

Before returning any items to us, please send a Return Request and we'll send all the information over to you. Please enclose this Return Request in the same package as the goods you're returning.

To avoid disappointment, ensure that the goods are packed carefully to avoid any damage. Unfortunately we cannot offer refunds unless the returned goods are unused (i.e. the tapes are not pulled and the fabric is in its original condition) – and all packaging that came with the order is returned at the same time (the curtains do not necessarily have to be in the packaging).

Send your ready made order cancellation returns to us at IMAKDYNAMIC UK LIMITED - branch, Borivojova 35/878, 13000 Praha 3, Czech Republic. Your money will be paid in to your bank account a maximum of 14 days after we've received the goods. To make sure you have proof of return, we recommend using a courier company to send the goods.

 

Third party rights

Except for our affiliates, directors, employees or representatives, a person, who is not a party to this Agreement has no right under the UK Contract (Right of Third Parties) Act 1999 to enforce any term of this Agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

 

Governing Law

The contract between us shall be governed by and construed in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us. English is the only language offered for the conclusion of the contract.

 

Entire Agreement

These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

 

Warranties and Liability

Subject to the Terms set out we warrant that upon delivery of the goods will correspond with their specification, will approximately correspond with the approximate description given by us and will be free from defects
